‼️ Urgent call for Action ‼️Cut off for comments TODAY - 16/10/26

We need your help with the proposed biodiversity regulations in the Western Cape.

Please take about three minutes to complete the form if you are involved in any of the following:

- Keeping pets or birds as a hobby.
- Breeding animals or growing and propagating plants .
- Buying or selling animals or plants, or running a pet shop or nursery.
- Transporting animals or plants, or taking part in shows and auctions.
- Farming, aquaculture or managing land.
- Rescue, rehabilitation, veterinary work or research.

Two associations have already asked for help and information, but the response has been limited. We cannot expect a handful of people to speak for everyone. Even a committee of ten can only do so much without support from its members.

When we ask you to read the summaries and explain how the proposals could affect you, please take it seriously. We need your knowledge and experience to explain what these changes could mean in practice.

Even if you live far from the Western Cape, please do not assume this does not matter to you. What is accepted in one province can influence similar proposals elsewhere. We should not wait until it reaches our own doorstep before getting involved.

You do not have to speak publicly. Read the summaries, select what applies to you and explain how the proposals could affect you. Even if you only keep a few birds at home, your input matters.

This concerns our animals, our hobbies, our businesses and the people who earn a living in these fields. Our associations need information and support from us to represent us properly.

Please complete the form and share it with others who may also be affected:

We need one another. Stand together and add your voice.

ECONOMIC UMBRELLA: THE WIDER VALUE CHAIN OF ANIMAL KEEPING

The economic impact of the Draft Animal Keeping By-law should not be assessed only by looking at animal owners, breeders or sellers. Animal keeping supports a much wider network of businesses, workers, service providers and community activities.

The Draft covers a particularly wide range of activities, including breeding, exhibiting, selling, transporting and keeping animals, as well as pet businesses, kennels and catteries, livestock, poultry, birds, rabbits and bees.

The economic umbrella

An animal keeper does not spend money only on the animal. Money generated through responsible animal keeping flows through a much broader economic ecosystem:

Animal keepers, hobbyists and breeders
↓
Feed manufacturers and agricultural producers
↓
Feed wholesalers, distributors and retailers
↓
Pet shops and agricultural suppliers
↓
Veterinarians, veterinary practices and animal-health professionals
↓
Diagnostic laboratories and testing services
↓
Veterinary medicines, supplements, disinfectants and animal-health products
↓
Cage, aviary, kennel, loft, coop, stable and enclosure manufacturers
↓
Welders, builders, carpenters and other tradespeople
↓
Wire mesh, steel, timber, roofing and building-material suppliers
↓
Nest-box, perch, feeder, drinker and animal-equipment manufacturers
↓
Bedding, substrate and hygiene-product suppliers
↓
Animal transporters, couriers and delivery services
↓
Microchip, identification, ring and record-keeping suppliers
↓
Groomers, trainers, behaviourists and boarding facilities
↓
Pet hotels, kennels, catteries and day-care facilities
↓
Animal welfare and rescue organisations
↓
Clubs, associations, shows, exhibitions and events
↓
Show venues, accommodation establishments and tourism businesses
↓
Caterers and food vendors
↓
Printers, signage businesses, photographers and media services
↓
Trophy, medal, rosette and award suppliers
↓
Websites, advertising services and online platforms

This means that a regulatory change affecting the number of people keeping animals, the scale at which they may keep them, whether they may breed or sell them, the facilities they must construct, or the cost and complexity of obtaining permits may have effects beyond the person directly regulated.

QUALITY IDENTIFICATION SHOULD NEVER COME AT THE BIRD’S EXPENSE

A bird ring may be small, but its quality can make a significant difference to the bird wearing it.

A ring that is too thin may bend, crack or develop sharp edges. One that is too thick or heavy may interfere with the bird’s normal movement. Rough or poorly finished edges can rub against the leg, cause wounds or catch on aviary mesh and nesting material.

That is why correct sizing, suitable wall thickness and smoothly finished edges matter.

Resplendent Bird Solutions rings are proudly manufactured in South Africa to specifications developed through years of experience in the avian industry. They are designed with durability, reliable identification, traceability and bird welfare in mind.

NUISANCE, INSPECTIONS & ENFORCEMENT

Responsible bird keepers understand that neighbours, animal welfare and public health must be protected.

The Draft Animal Keeping By-law contains provisions dealing with nuisances, complaints, inspections, enforcement, seizure and penalties.

These are important powers.

For that reason, they also need to be clear, fair, practical and proportionate.

Good enforcement should deal effectively with genuine problems without unnecessarily penalising responsible animal keepers.

PASA encourages Cape Town aviculturists to look beyond the headline issues and read these provisions carefully.

Ask:

What constitutes a nuisance?

How would the provision be applied?

Are the powers and responsibilities sufficiently clear?

Could responsible bird keepers be unintentionally affected?

And, importantly, what practical alternative would you recommend?

BREEDING & SELLING

Cape Town Animal Keeping By-law 2026: What Bird Keepers Need to Know

If you breed birds in Cape Town — even as a hobby — this part of the proposed by-law deserves your attention.

The draft contains provisions that may have implications for breeding, keeping, selling and advertising animals, including advertising through online and social-media platforms.

This discussion therefore extends beyond large commercial facilities.

It may also matter to hobby breeders, club members and ordinary bird keepers who occasionally sell surplus captive-bred birds.

Responsible breeding and responsible trade should be supported.

But regulation also needs to recognise the difference between commercial activity, organised hobby breeding and ordinary private bird keeping.

Read the provisions. Consider how they would work in practice. If you believe something should change, explain why and propose a workable alternative.

DOES YOUR AVIARY COMPLY?

Cape Town Animal Keeping By-law 2026: What Bird Keepers Need to Know

The Draft Animal Keeping By-law isn't only about how many birds you keep.

Bird keepers should also look carefully at the proposed requirements relating to aviaries, construction materials, floors, positioning and distances from boundaries, dwellings, roads and certain water sources.

These provisions could have practical consequences for both new aviaries and existing bird-keeping facilities.

The important question is whether a single construction approach is appropriate for the many different forms of responsible bird keeping.

What works for a large parrot aviary may not necessarily be appropriate for a small finch, canary or budgie setup.

PASA supports appropriate standards that protect animal welfare, hygiene and neighbours. At the same time, those standards should be practical, proportionate and appropriate to the species and circumstances concerned.

Before commenting, read the proposed requirements.

Cape Town Animal Keeping By-law 2026: What Bird Keepers Need to Know

MORE THAN 5 BIRDS?

This is one of the provisions Cape Town bird keepers need to read carefully.

The draft provides that on residential premises, keeping more than five birds in captivity may bring a person within the City's permit requirements.

That means this discussion isn't only about large commercial breeders. A person keeping three breeding pairs already has six birds.

The question is not whether responsible animal keeping should be regulated.

The question is whether a fixed numerical limit appropriately reflects the very different realities of keeping finches, budgies, canaries, parrots and other birds.

Read what the draft proposes and decide for yourself:
PASA – Cape Town Animal Keeping By-law Information

Affected aviculturists are also invited to join the discussion on Monday evening, 14 September.

Don't just disagree. Understand the provision. Explain its practical effect. Recommend an alternative.

AVICULTURE – HAVE YOUR SAY

Cape Town Animal Keeping By-law 2026: What Bird Keepers Need to Know

The City of Cape Town’s Draft Animal Keeping By-law 2026 could have implications for bird keepers, hobby breeders, commercial breeders, bird clubs, pet owners and businesses.

PASA believes it is important that the avicultural community takes part in this process in an informed and constructive way.

We support the purpose. We are scrutinising the mechanism.

Good animal welfare and responsible aviculture are not opposing objectives. Regulation should also be practical, proportionate, scientifically informed and appropriate to the animals being kept.

PASA has prepared an information page explaining the proposed by-law, the areas that may affect aviculture, the public-comment process and information regarding the stakeholder discussion.

Read the information and make an informed submission:

Please share this with Cape Town bird keepers, breeders, clubs and businesses who may be affected. Have your say through the official public-participation process.
