It's complicated. And being a Smart Pet Parent means doing right by every animal, not just your own.
In South Africa, animals are legally classified as property, which means simply keeping a found animal without following the correct process could, in certain contexts, be considered theft. Local municipal by-laws may also place specific duties on anyone who finds a stray. The good news? The right steps are straightforward.

1. Check for a microchip
Take the animal to your nearest vet or SPCA. They will scan for a chip at no charge. This is the fastest route to finding an owner. No chip? Don't give up. Social media and community networks are powerful tools.
2. Notify the right authorities
Contact your local SPCA and/or municipal pound. Animal welfare falls under the Animals Protection Act 71 of 1962, enforced by the NSPCA and local municipalities. SAPS is only a fallback where no SPCA or welfare organisation is available in your area.
3. Post, share and put up notices
Share on local Facebook groups like "Lost & Found Pets Johannesburg" or your area's equivalent. Put up physical flyers at vet clinics, local shops and in your neighbourhood. The more eyes, the better the chance of a reunion.
4. Keep advertising for at least 10 days
There is no single national minimum, but South African municipal by-laws set a "pound period" during which a registered owner can legally reclaim their pet. Typically 7 days (eThekwini) to 10 days (City of Cape Town) for small animals. As a safe and ethical benchmark, advertise actively for a minimum of 10 days before considering any other arrangement. Check your local municipality's by-laws, as the period can vary. Only once this window has passed and all reasonable steps have been taken, does keeping or rehoming the animal become defensible.
While you wait: You can temporarily foster the animal, but only after completing steps 1 to 4 above. Fostering is a kindness, not a claim. Keep advertising throughout the full 10-day period. Every day matters when someone is missing their pet.
