When an incident involving a dog is reported, the dog warden or appropriate law enforcement agency investigates what happened. They look at the circumstances to determine whether the dog meets Ohio’s legal definition of a nuisance, dangerous or vicious dog. This could involve a bite or other behavior, such as a dog chasing someone in a threatening or menacing way.

If a dog is designated, the owner is notified and receives information about the requirements that apply to continue to own the dog. The owner has 10 days from the date of the designation to file and challenge it in court. The court reviews the designation and either upholds or overturns it.

If you have questions about how Avery’s Law may apply to a specific situation, please consult an attorney who can provide legal advice based on the circumstances of your case.

To learn more about the new law, check out our FAQ linked in the comments below.

🐾 Where’s Waldo? Hopefully, in his new family’s living room soon.❤️

Meet Waldo, an 11-year-old, 52-pound gentleman who still has plenty of life and love to share!

This handsome gray-and-white boy loves attention, greets familiar faces with a wagging tail and soft eyes, and takes treats oh-so-gently. And don’t let his senior status fool you! Waldo still has a playful side, complete with play bows and zoomies after a ball. 🥹

Waldo has been waiting at the Animal Resource Center since June 18, and he deserves a place to spend his golden years feeling safe, comfortable and loved.

He would do best with a patient, experienced family who can offer him a quieter environment and all the affection his heart can handle. Have another dog at home? We ask that you bring them in for a meet-and-greet with Waldo before adoption.

Let’s help Waldo find the loving home he deserves. His shelter days have gone on long enough. ❤️

🎃 Halloween is spooky. A pet emergency doesn’t have to be.

Before trick-or-treaters head out this Halloween, Montgomery County Animal Resource Center has a few tips to keep your pets safe:

🍬 Keep the candy out of reach! Chocolate and other Halloween treats can be toxic to pets. If your dog eats something they shouldn’t, call your vet or the ASPCA Poison Control Center at (888) 426-4435.

🐶 Keep costumes comfy! Make sure costumes don’t restrict movement or breathing, and avoid small pieces your pet could swallow.

🪪 Check those tags! Current licenses, up-to-date microchips and ID tags can help reunite you with a lost pet.

🎃 Keep decorations paws-off! Candles, pumpkins, fake webs and other decorations can cause injuries or become choking hazards.

🚪Give pets a break from the door! Keep pets in a quiet room if the constant doorbell is stressful, or if your pet is prone to slipping out.
