SUPREME COURT REMINDS COMELEC: STOP ACTING ABUSIVELY IN DECLARING NUISANCE CANDIDATES

FIRST ON BATAS PH: The Supreme Court (SC) has found that the Commission on Elections (COMELEC) gravely abused its discretion and violated the right to due process when it declared senatorial bet Subair Guinthum Mustapha as a nuisance candidate for the 2025 midterm elections.

In a ruling penned by Chief Justice Alexander Gesmundo, the SC En Banc castigated the poll body for whimsically and invalidly declaring Mustapha as a nuisance candidate simply because he obtained minimal votes in previous elections, he could not possibly obtain a sufficient number of votes during the 2025 election.

The SC also reminded the COMELEC to stop depriving the people of a legitimate choice by declaring candidates as nuisance candidates simply because it perceives that said candidates have low chances of winning, as purportedly shown by their previous dismal votes.

In January 2025, Mustapha obtained a Supreme Court TRO, blocking Comelec's declaration of him as a nuisance candidate and prompting the reprinting of 6 million ballots.
