The Delhi High Court recently gave a landmark judgement on animal welfare: it recognised that animals cannot be treated as inanimate objects.
This came in context of a dispute of custody regarding 3 rescued and adopted pet dogs. A trial court had earlier ruled that the pets be returned to their original caregivers but the High Court upheld that separating the animals from their adoptive caregivers can cause emotional distress. Therefore, it must be considered before making custody rulings.
The ruling is a step towards animal sentinece: the acknowledgement that animals too have subjective consciousness and the ability to feel emotions, sensations, and pain. While it may seem obvious to us, it is not explicitly mentioned in Indian legislation, and therefore a complicated legal point. That makes this judgement a big win for animal welfare.
Hopefully, this idea will eventually extend towards community animals as well so that they’re not forced to spend their lives in confinement without any fault of their own.
